FloraFlex Returns, Refunds & Warranty Policy

This Returns, Refunds & Warranty Policy applies to products purchased directly from Cresthaven Agricultural Corp. ("Cresthaven," "we," "us," or "our").
Products purchased from an independent authorized distribution partner, reseller, retailer, marketplace, or other third party should generally be returned to the original seller unless Cresthaven expressly authorizes otherwise.
1. Return Authorization Required
No product may be returned without prior written authorization from Cresthaven and an approved return merchandise authorization ("RMA").
Unauthorized returns may be refused or returned to the sender at the sender's expense.
Return requests should be submitted using the customer-support or return-request method provided on www.floraflex.com.
2. Standard Return-to-Stock Requests
Standard stocked products may be eligible for return within 30 days after delivery if approved by Cresthaven and if the product is:
- new and unused;
- in its original packaging;
- unmarked and undamaged;
- complete;
- a current product; and
- suitable for resale.
Approved return-to-stock merchandise is subject to a 15% restocking fee, unless Cresthaven waives the fee in writing.
Customer is responsible for return freight and other associated expenses unless the return results from Cresthaven's error.
3. Non-Returnable Products
Unless Cresthaven expressly approves otherwise in writing, the following are non-returnable:
- custom products;
- private-label products;
- special-order products;
- made-to-order products;
- products already placed into production;
- direct-import orders;
- full-container orders after applicable commitment points;
- clearance or final-sale items;
- opened nutrients, fertilizers, additives, chemicals, or other consumables;
- partially used products;
- contaminated products;
- improperly stored products;
- products damaged after delivery; and
- products Cresthaven reasonably determines cannot be safely or commercially resold.
4. Refunds and Credits
Approved refunds will generally be issued to the original payment method where practical.
Where an account-credit arrangement, commercial credit, financing, factoring, or other payment structure applies, Cresthaven may issue an account credit or otherwise process the adjustment in a commercially reasonable manner consistent with the applicable transaction documents.
Original outbound freight, return freight, accessorial charges, customs charges, duties, taxes, payment-processing costs, and other transaction costs may be non-refundable except where the return results from Cresthaven's error or applicable law requires otherwise.
5. Damaged-in-Transit Claims
Visible freight damage should be documented on the delivery receipt, proof of delivery, or bill of lading before signing whenever reasonably possible.
Customer should photograph:
- damaged products;
- damaged packaging;
- pallets;
- labels;
- container or trailer condition where relevant; and
- any visible evidence supporting the claim.
Do not discard damaged freight or packaging before Cresthaven or the carrier confirms that disposal is permitted.
Transit damage may be subject to the carrier's claim process and the Shipping & Delivery Policy.
6. Shortages and Shipping Errors
Customers should promptly report:
- missing products;
- quantity shortages;
- incorrect products;
- incorrect pallet quantities; or
- other shipping discrepancies.
Cresthaven may require photographs, packing lists, pallet labels, delivery documentation, or other reasonable evidence.
7. Defective Products
If a product is believed to be defective or materially nonconforming, Cresthaven may require:
- photographs;
- video;
- serial numbers;
- lot numbers;
- production information;
- proof of purchase;
- troubleshooting;
- testing;
- return of the product; or
- other reasonable verification.
If an eligible product is confirmed defective during an applicable warranty period, Cresthaven may, at its option:
- repair the product;
- replace the product;
- refund the amount paid for the affected product; or
- issue account credit for the affected product.
8. Product-Specific Warranties
A product-specific written warranty, if provided, controls over conflicting general warranty language in this Policy.
Warranty periods and remedies may differ by product category.
Customers should retain proof of purchase and any serial, lot, or production information associated with warranty products.
9. Warranty Exclusions
Warranty coverage does not apply to damage, failure, or performance issues resulting from:
- misuse;
- abuse;
- improper installation;
- improper application;
- improper storage;
- unauthorized modification;
- contamination;
- failure to follow instructions;
- failure to follow labels or safety information;
- incompatibility with third-party equipment, chemicals, or products;
- improper electrical conditions;
- normal wear;
- environmental conditions;
- acts of nature;
- transportation damage occurring after risk of loss has passed; or
- other causes outside Cresthaven's reasonable control.
10. Agricultural Performance
Substrates, nutrients, irrigation products, lighting equipment, and other cultivation products operate within systems affected by conditions Cresthaven does not control.
CRESTHAVEN DOES NOT GUARANTEE CROP YIELD, HARVEST WEIGHT, CROP QUALITY, PLANT PERFORMANCE, CROP VALUE, PRODUCTION VOLUME, OR CULTIVATION PROFITABILITY.
To the maximum extent permitted by law, Cresthaven will not be responsible for lost crops, lost production, lost yield, lost profits, or consequential agricultural losses.
11. Limitation of Remedy
Except where applicable law requires otherwise, Cresthaven's obligation for a product proven defective or materially nonconforming is limited to the remedies stated in this Policy or an applicable product-specific written warranty.
The Terms & Conditions of Sale contain additional limitations of liability that apply to purchases from Cresthaven.
12. Legacy Products or Transactions
Cresthaven Agricultural Corp. is a separate legal entity from entities that previously operated or sold products under or in connection with the FloraFlex name.
Assistance provided regarding a product originally sold in a transaction involving a prior entity does not by itself constitute an assumption by Cresthaven of that entity's debts, refund obligations, account credits, warranty obligations, or other liabilities.
Any Cresthaven responsibility relating to a historical transaction exists only to the extent expressly assumed or separately accepted by Cresthaven in writing.
